Murder in Arizona

Our Phoenix Criminal Defense Lawyers Can Fight for You

Murder is considered the most serious violent crime in Arizona and the rest of the United States. Not only can a conviction result in imprisonment for the rest of your life, but also execution. Even before you step foot in court, merely being accused of homicide can significantly damage your personal life and professional career. It is imperative to obtain legal representation from an experienced and aggressive lawyer to protect your rights, future, and freedom.

At Maria Jones Law Firm, we understand how frightening, stressful, and otherwise emotionally overwhelming the legal process can be. With more than 15 years of legal experience, our legal team can investigate your case, collect and review evidence from law enforcement, obtain professional help from field experts, and create an effective and personalized defense strategy to help you obtain the best outcome possible.

First-Degree & Second-Degree Murder

When a person kills another individual, it is considered a murder, which is also known as homicide. There are two types of murder charges in Arizona: first-degree and second-degree murder.

First-degree murder occurs when a person intentionally kills someone else with premeditation and malice aforethought. Furthermore, a person can be charged with this degree of murder if someone kills another person as a result of committing a serious felony (e.g. robbery, kidnapping, sexual assault, child molestation, etc.), according to the “felony murder rule.”

First-degree murder is the most serious degree of homicide and a Class 1 felony, punishable by up to either a life sentence (with or without the possibility of parole) or the death penalty. If you gain parole, you must serve at least 25 years—35 years if the alleged victim is a minor under 15 years old or an unborn child—before becoming eligible for a parole hearing.

On the other hand, second-degree murder is defined as the intentional killing of a human being without any premeditation. In other words, the killing occurred in the heat of the moment. Second-degree murder carries a mandatory prison sentence between 10 years and up to 25 years.
