First-Degree & Second-Degree Murder

When a person kills another individual, it is considered a murder, which is also known as homicide. There are two types of murder charges in Arizona: first-degree and second-degree murder.

First-degree murder, as per ARS § 13-1105, occurs when a person intentionally kills someone else with premeditation and malice aforethought. Furthermore, a person can be charged with this degree of murder if someone kills another person as a result of committing a serious felony (e.g. robbery, kidnapping, sexual assault, child molestation, etc.), according to the “felony murder rule.”

Alleged acts that constitute first degree murder charge in Arizona may include –

• A person knows that his or her actions will cause death of the victim and still carries them out
• A person indulges in sexual acts (alone or in a group) that lead to death of another person
• A person intentionally ends the life of a law enforcement officer

First-degree murder is the most serious degree of homicide and a Class 1 felony, punishable by up to either a life sentence (with or without the possibility of parole) or the death penalty. If you gain parole, you must serve at least 25 years—35 years if the alleged victim is a minor under 15 years old or an unborn child—before becoming eligible for a parole hearing.

On the other hand, second-degree murder as per ARS § 13-1104 is defined as the intentional killing of a human being without any premeditation. In other words, the killing occurred in the heat of the moment. Second-degree murder, charged as Class 1 felony, carries a mandatory prison sentence between 10 years and up to 25 years.

A person may be charged with second degree murder in Arizona if –

• They intentionally cause the death of an individual
• Commit an act which is expected to result in serious injury or the death of an individual, or
• Indulge in acts involving extreme indifference to human life, resulting in reckless behavior that leads to the death of another person.
